Argentina to file criminal charges over Falklands oil drilling

BUENOS AIRES — Argentina is preparing to file criminal charges against Israeli energy company Navitas Petroleum and several of its executives over oil exploration and production activities in the Falkland Islands, escalating a long-running dispute with the United Kingdom over sovereignty of the South Atlantic territory.

The planned legal action follows a renewed push by Argentine President Javier Milei to challenge what his government regards as British control over the islands. The dispute has taken on a new dimension as Argentina seeks to impose restrictions on companies involved in oil and gas operations in the territory and as questions have emerged over the future position of the United States.

Argentina’s government said Foreign Minister Pablo Quirno would submit a criminal complaint against several Navitas subsidiaries, business partners and corporate directors involved in operations in the islands.

The government alleges that the companies have breached Argentine law by holding licences for hydrocarbon exploration and exploitation that were issued by the United Kingdom in the North Falkland Basin.

Navitas Petroleum did not immediately respond to a request for comment.

The action centres in particular on the Sea Lion offshore oil project, which has become a major point of contention between Buenos Aires and London. Navitas operates the project and holds a 65% stake, making it one of the principal companies involved in the development of the region’s offshore energy resources.

Milei has increasingly linked the oil project to Argentina’s broader sovereignty claim. In remarks last week, he announced measures aimed at companies participating in oil and gas activities around the Falkland Islands, warning that potential penalties could also affect shareholders, directors and suppliers.

The Argentine president has argued that companies operating in the territory without approval from Buenos Aires should face consequences if they seek to conduct business in Argentina.

The dispute is particularly sensitive because sovereignty over the Falkland Islands has remained unresolved between Argentina and Britain for generations.

Britain has administered the islands since 1833, apart from the brief period of Argentine occupation during the 1982 Falklands war. The conflict began after Argentine forces invaded the islands, prompting the British government under Prime Minister Margaret Thatcher to send a military taskforce to retake the territory.

The war ended with British forces regaining control. The sovereignty dispute, however, continued after the conflict.

Britain maintains that the islanders have the right to determine their own political future and has repeatedly rejected Argentina’s sovereignty claim. Argentina, meanwhile, argues that the islands form part of its national territory and continues to call for negotiations over their status.

The latest escalation comes amid speculation that US President Donald Trump may be reconsidering Washington’s long-standing approach to the dispute.

The United States officially maintains a position of neutrality regarding the sovereignty question. In practical terms, however, Washington has historically recognised British administration of the islands.

Trump’s recent comments have fuelled speculation that the US position could evolve. Asked whether he was reviewing Washington’s stance on the Falklands, Trump said he regularly reviews US positions and described the issue as one of many matters under consideration.

Milei interpreted the remarks as potentially significant for Argentina’s longstanding campaign to regain sovereignty over the islands.

The Argentine president has portrayed the changing international environment as an opportunity for his country. He has described what he called “winds of change” around the world as favourable to Argentina’s position.

Milei has also emphasised his close political relationship with Trump and his commitment to what he describes as Western values. Argentina has sought to strengthen its relationship with the United States under Milei, making the possibility of a shift in Washington’s position particularly important to Buenos Aires.

British officials have responded firmly to the Argentine government’s renewed claims.

UK ministers have rejected Milei’s statements and stressed that the Falkland Islands will remain British for as long as their inhabitants wish them to. The position reflects Britain’s longstanding emphasis on the principle of self-determination for the island’s population.

The disagreement over offshore oil resources adds an economic dimension to the sovereignty dispute.

The waters surrounding the Falklands are believed to contain significant hydrocarbon potential, and development of offshore resources could generate substantial economic benefits if commercially viable production expands.

For Argentina, foreign-operated oil projects in waters it considers its own are viewed as a challenge to its territorial claim. For Britain and the Falkland Islands authorities, however, energy development is conducted within the framework of British administration and local regulatory authority.

The conflicting legal positions mean that companies involved in offshore projects face an unusually complicated political environment.

Navitas’s involvement has placed the company at the centre of that confrontation. The company has invested heavily in the Sea Lion project and is now facing the possibility of legal and commercial pressure from the Argentine government.

Milei’s administration has indicated that its measures could extend beyond the companies directly involved in drilling. Shareholders, executives, suppliers and other commercial partners could potentially be affected under the proposed Argentine sanctions.

The government says such measures are necessary to defend Argentina’s sovereignty claim and prevent companies from benefiting from resources in territory Buenos Aires considers Argentine.

Critics of the approach, however, could argue that criminal proceedings against foreign companies risk increasing tensions without resolving the underlying sovereignty dispute.

The Falklands question has already been a recurring source of diplomatic friction between Argentina and Britain. Previous Argentine governments have pursued diplomatic campaigns for negotiations, while British governments have consistently opposed talks that could undermine the islanders’ right to determine their own future.

The possibility of changing US policy has added another layer of uncertainty.

Speculation over Washington’s position has circulated for months. Earlier reports suggested that US officials had considered reviewing aspects of Washington’s approach to the Falklands in the context of wider disagreements between Trump and the British government.

The issue has reportedly become linked to broader disputes over defence spending, NATO commitments and Britain’s approach to US foreign policy.

A major change in the US position would carry symbolic significance for Britain, given Washington’s role during the 1982 conflict.

Although the United States initially sought to maintain a diplomatic role between Britain and Argentina, the administration of President Ronald Reagan ultimately provided strong diplomatic backing to Britain. That support was significant because Washington was also dealing with Argentina’s military government at the time.

The history of the conflict continues to shape perceptions on both sides.

For Argentina, the islands remain a matter of national identity and territorial integrity. For Britain and many Falkland Islanders, the issue is centred on self-government and the right of the island’s population to decide its own political status.

The new dispute over oil exploration has brought those competing principles into sharper focus.

Argentina’s planned criminal complaint against Navitas is unlikely by itself to settle the sovereignty question, but it signals that Milei’s government intends to use legal, economic and diplomatic tools to strengthen its claim.

For companies operating in the region, the dispute creates additional uncertainty at a time when offshore energy projects require long-term investment and political stability.

For Britain, the challenge is equally sensitive. Any perceived change in international support could have implications beyond the immediate oil dispute, particularly if other countries interpret a shift in US policy as weakening Britain’s position.

For Argentina, meanwhile, the coming months could test how far its increasingly assertive approach can influence international opinion without triggering a wider diplomatic confrontation.

The planned legal action against Navitas therefore represents more than a dispute between a government and an energy company. It is part of a broader struggle over territory, natural resources, international recognition and national identity that has remained unresolved for more than a century.

As Argentina prepares to pursue criminal proceedings and Britain defends its position, attention is likely to remain focused on Washington and on whether Trump’s administration ultimately changes its approach.

For now, the sovereignty dispute remains firmly unresolved, while the development of oil resources around the Falklands has added a powerful economic incentive to an already deeply contested question.
