A British photographer is facing forced deportation from Sweden and separation from his 16-month-old son after Swedish migration authorities ruled that national immigration enforcement outweighs his rights to family life. The legal battle highlights the complex post-Brexit legal realities facing British nationals living across the European Union.

Simon Montgomery applied for residency in Sweden following the birth of his son last year. Because his son holds German citizenship through his mother, Montgomery argued that his right to remain is protected under European Union freedom of movement provisions. Although the couple separated shortly after the child’s birth, Montgomery established a formal, legally recognized joint custody agreement via municipal family law services, actively caring for his son three days a week. Having grown up without a father himself, Montgomery expressed a deep commitment to remaining physically present during his child’s crucial early development stages.

However, Sweden’s Migration Agency rejected Montgomery’s residency application, claiming he failed to demonstrate “actual care” for the child, who at six months old was still staying overnight with his mother. The agency further suggested that Montgomery could maintain a parental relationship from abroad by entering Sweden on short-term, visa-free visits.

Simon Montgomery submitted a formal residency application in Sweden following the birth of his son last year. Because his child holds German citizenship through his mother, Montgomery’s legal team argued that his right to reside in the country should be protected under European Union freedom of movement provisions governing family members of EEA citizens. Although the couple separated shortly after the child’s birth, Montgomery established a legally recognized joint custody agreement mediated by Swedish municipal family law services, actively participating in his son’s daily routine and caring for him three days a week. Having grown up without a father in his own life, Montgomery expressed an unyielding commitment to remaining physically present in his infant son’s day-to-day upbringing.

However, Sweden’s Migration Agency formally rejected Montgomery’s residency application, asserting that he failed to demonstrate “actual care” for the infant because the child primarily resided and stayed overnight with his mother during his first six months. In a move described by legal experts and family advocates as deeply controversial, the agency suggested that Montgomery could preserve his parental bond from abroad by taking advantage of visa-free entry rules to visit Sweden on short-term trips.

A Swedish migration court subsequently upheld the deportation decision, explicitly concluding in its ruling that the Swedish state’s overarching interest in regulating immigration outweighs Montgomery’s right to the protection of his private and family life under a judicial proportionality assessment. Montgomery’s legal representatives have now lodged an urgent appeal with Sweden’s higher migration court, arguing that forcibly removing a primary caregiver during a critical early attachment phase creates profound emotional instability for an infant EU citizen and directly violates Article 8 of the European Convention on Human Rights.

The ongoing judicial battle leaves Montgomery trapped in severe legal uncertainty and administrative isolation. Fearing that stepping foot outside Swedish borders would trigger an immediate re-entry ban and permanently block him from returning to his child, he remains unable to travel back to the United Kingdom to visit elderly relatives, including his 98-year-old grandmother. As the higher migration court deliberates whether to take up the landmark appeal, the case stands as a stark illustration of how post-Brexit regulatory frameworks and strict immigration enforcement can directly collide with international child welfare standards and basic human rights principles.

A lower migration court upheld the deportation order, explicitly stating in its ruling that the state’s interest in regulating immigration takes precedence over Montgomery’s right to a private and family life. Montgomery’s legal team has lodged an appeal with the higher migration court, arguing that removing the father during a critical attachment phase violates Article 8 of the European Convention on Human Rights and creates emotional instability for an infant EU citizen.

The legal standoff leaves Montgomery in administrative limbo, unable to leave Sweden to visit aging relatives in the United Kingdom for fear of being barred re-entry. As higher courts review the appeal, the case underscores broader concerns regarding how strict post-Brexit immigration enforcement intersects with international child welfare conventions.
