Man Arrested Over Alleged Texas Capitol Attack Plot

A 40-year-old Texas man has been arrested after authorities said they received credible information about an alleged plan to carry out a violent attack at the Texas State Capitol in Austin.

Benny Caldera Jr, a resident of Converse in the San Antonio area, was arrested by Texas Department of Public Safety officers at about 3am on Wednesday after investigators were alerted to a potential attack planned for Thursday, 1 October. Authorities said the Federal Bureau of Investigation also assisted in the investigation and arrest.

Caldera was subsequently charged with a felony terroristic threat against a public servant and booked into Bexar County Jail. Reports initially indicated that he was being held on a $75,000 bond. Later developments reported by Texas authorities indicated that he was transferred into federal custody for additional proceedings connected with the investigation.

The arrest followed information received by state authorities on Tuesday evening. The Texas Department of Public Safety said the information concerned an individual allegedly planning a violent attack against the state Capitol.

Investigators moved quickly after receiving the information. According to an arrest warrant affidavit reported by local media, authorities interviewed a person known to Caldera who said he had made statements indicating an intention to attack the Capitol.

The affidavit alleges that Caldera told the individual he was going to the Capitol and would “shoot it up”. The same person reportedly told investigators that Caldera had also expressed concern that he might not return, according to the arrest documents.

Authorities have also alleged that Caldera expressed anger toward the American Israel Public Affairs Committee, commonly known as AIPAC. According to the warrant affidavit, he made an extreme statement concerning people associated with the organisation. These statements form part of the allegations contained in the arrest documents and have not been independently established in court.

The arrest took place at Caldera’s residence in Converse, a community northeast of San Antonio in Bexar County. DPS SWAT officers carried out the operation after state investigators and federal authorities assessed the information they had received.

The investigation has involved multiple agencies, reflecting the seriousness with which authorities treated the reported threat. Texas DPS said its Criminal Investigations Division worked with the FBI to examine the information and determine the circumstances surrounding the alleged plan.

The Texas Capitol remained open during normal operating hours after the arrest. State officials, however, increased security around the complex while the investigation continued.

Patsy Spaw, secretary of the Texas Senate, notified state lawmakers and Capitol personnel about the threat and the arrest. Her communication indicated that security would be increased while authorities continued investigating the circumstances.

According to reporting by the Texas Tribune, Spaw described the person arrested as the main suspect in a planned attack that allegedly involved suspected co-conspirators. However, the Texas Department of Public Safety’s public statement concerning Caldera did not announce additional suspects or arrests.

That distinction is important as the investigation remains ongoing. Authorities have not publicly established that other people were involved, and the available information does not indicate that any additional individuals have been charged in connection with the alleged plan.

The Capitol itself continued normal operations. State authorities said there was no indication of an ongoing threat to legislators, staff members or members of the public following Caldera’s arrest, although law enforcement maintained an increased presence around the building.

The incident comes at a time when security around government buildings in the United States remains a significant concern for law enforcement agencies. State capitols regularly host lawmakers, staff, visitors, demonstrations and public events, creating complex security challenges for authorities responsible for protecting the facilities.

For Texas officials, the immediate priority following the reported threat was to determine whether the information represented a genuine and imminent danger. The decision to deploy SWAT officers and involve the FBI reflected the seriousness with which investigators approached the information.

Governor Greg Abbott thanked the Texas Department of Public Safety and the FBI for their roles in the arrest. He said Texas would not tolerate threats of violence against the state Capitol.

The investigation is expected to examine the statements attributed to Caldera, his communications, his intentions and whether he had taken any concrete steps toward carrying out an attack.

At this stage, the allegations remain accusations. An arrest or criminal charge does not establish guilt, and Caldera will have the opportunity to contest the allegations through the legal process.

The case also raises questions about how law enforcement agencies identify and respond to threats before an attack takes place. In this instance, authorities said information provided to them on Tuesday evening enabled investigators to act before the alleged attack date.

The reported timing was particularly significant. According to state authorities, the alleged attack was planned for Thursday, meaning investigators had only a limited period in which to assess the information, identify the suspect and determine whether intervention was necessary.

The rapid response prevented the alleged plan from reaching the stage of an attack, although investigators must now establish the full circumstances behind the threat.

The FBI’s involvement could also result in additional federal charges. Texas DPS said Caldera was transferred from Bexar County custody into federal custody on Wednesday evening to face additional federal charges connected with the possible planned attack.

Details about those federal proceedings were not immediately available, and the precise nature of any additional charges will depend on the continuing investigation.

Caldera’s attorney was being sought for comment, but no detailed public response from his legal representation had been reported at the time of the latest available information. His defence will have an opportunity to challenge the allegations as the case moves forward.

The case is also likely to receive continued attention because of the location allegedly targeted. The Texas State Capitol is the centre of state government in Austin and houses the Texas Legislature, including the Senate and House of Representatives.

Security measures at the Capitol have increased during periods of heightened political tension or when authorities have received threats. Law enforcement agencies must balance public access to the building with measures designed to protect lawmakers, employees and visitors.

The current investigation follows another Texas Capitol threat in 2025 that prompted an evacuation and subsequent arrest. That earlier case involved a separate suspect and circumstances, and there is no indication from authorities that the two incidents are connected.

For now, authorities have emphasised that there is no known continuing threat to the Capitol following Caldera’s arrest. Nevertheless, additional officers are expected to remain visible at the complex while investigators work to establish the full details of the alleged plot.

The case highlights the role of early reporting and investigative cooperation in responding to potential threats against public institutions. Information provided to authorities can trigger an assessment involving state and federal agencies, with investigators then determining whether the available evidence supports an arrest or other intervention.

In Caldera’s case, authorities say that process led to his arrest before the alleged attack date. The criminal proceedings will now determine what evidence can be presented and whether the allegations can ultimately be established in court.

Until then, the details contained in the arrest affidavit remain allegations rather than findings of guilt. Investigators are continuing to examine the circumstances surrounding the reported threat, while prosecutors will determine how the case proceeds.

For Texas lawmakers and Capitol employees, the immediate danger identified by authorities appears to have been addressed through the arrest. But the increased security presence will continue as officials work to ensure that the state Capitol remains safe and accessible while the investigation moves forward.
